The parties agree that their relations will be governed exclusively by this contract, with the exclusion of any condition previously available on the site.

The present conditions are intended to define the terms of sale between Ornibird and the user, from ordering to services, through payment and delivery.

Article 6. Delivery.
Your purchases are packed with the utmost care, using protective materials. Our attention to packaging allows us to offer a delivery in the best conditions. The products shipped are insured free of charge against deterioration and theft for the duration of the transport. You must therefore ensure the integrity of your order and all the items that compose it on receipt of the package and in the presence of the person making the delivery in order to issue a reservation if necessary. We offer two carriers on our site to send your order.

The following cases of force majeure in particular release the company Ornibird from its obligation of delivery: war, revolt, fire, strikes, accident and impossibility to be supplied itself by the suppliers or the normal transporters.
In the following cases, Ornibird may temporarily suspend delivery: internal network failures, telephony disruptions, Internet problematic access problems and the like. Article 7. Terms of order.
The order is placed by the customer at Ornibird via the website. The order can only be registered on the site if the user has clearly identified himself:
- by entering his client identifier which is strictly personal to him.
- or by completing the registration form enabling him to obtain the assignment of a customer identifier which will be transmitted to him by confirmation of mail.
All orders imply acceptance of prices and description of products available for sale. (See ART.5 of the Conditions of Sale). By placing an order online, the customer explicitly wishes to enter into a sales contract with Ornibird and to agree with these terms and conditions. The customer is informed of the confirmation of this order by e-mail, hereinafter called confirmation e-mail, which summarizes the terms of the order. Ornibird undertakes to honor the orders received on the website only within the limit of the available stocks of the products. Article 8. Methods of payment.
In order to process orders in the shortest possible time and to offer the best service, Ornibird invites the customer to pay the purchase price at the time of placing the order. In the event of waiver of the order (see ART.10 of the terms of sale), Ornibird is obliged to reimburse the sums paid by the customer, without compensation. The costs of returning the parcel being paid by the customer (see ART.10 of the conditions of sale). The purchase price is paid when ordering via the Hipay or Paypal server (see ART.9 of the terms of sale) to which Ornibird makes use to have the customer's bank details encrypted and then transmitted in a secure way:

Article 9. Security of electronic funds transfers.
The transaction procedures on the Ornibird merchant site take place with the highly secure payment service provider Hipay or Paypal.

Not only does this mechanism preserve the confidentiality of information with respect to Ornibird, it also allows for the incorporation of new payment methods without requiring any modification to the programming of the merchant's site.
In addition, all transaction fees (fees of the various financial institutions) are entirely paid by Ornibird.
At the end of the payment process, the hand is returned to the merchant's site so that he can perform the "after-sale" processing of his choice (stock update, possibility to download intangible goods, etc.).
This system therefore offers all the advantages for payments on the Ornibird merchant site:
- Confidential information is protected using SSL or SET technologies. No information of this type therefore passes in clear on the network.

- The merchant or applications on the merchant's site are not aware of the buyer's credit card number.
- Any communication between the client browser and Hipay or Paypal is done using 128 bit SSL encryption techniques. Hipay and Paypal are protected by different firewall systems and protocol conversions to prohibit access to data or payment processors by unauthorized visitors.
Article 10. Right of renunciation.
The buyer has the right to notify Ornibird that he waives the purchase without payment of a fine and without giving reasons within 14 working days from the day following the delivery of the order.

In case of return of parcels and after having warned Ornibird by mail within the deadlines described above, the expenses of return of the parcel are always chargeable to the customer. Moreover, the customer is advised to work with the postal services for a secure and guaranteed delivery. The customer will be asked to protect the returned items with the utmost care.
To make your life easier when you return an item, Ornibird offers to refund you by transfer to your bank account. In order to benefit from this practical, safe and fast service, simply fill in your bank account number on the sending note that accompanies the returned items. We will make the transfer as soon as possible (max. 30 days), depending on when Ornibird has really become aware of the waiver and after the products have been returned to Ornibird. The costs of sending the parcel are not refunded.
In case of abusive returns, Ornibird reserves the right to refuse a subsequent order.

Article 11. Warranties and after-sales service.
